A POA is a legal document that allows you to appoint another person to act on your behalf. This is commonly used by people that need someone to represent them in legal matters abroad.
For example, if you are buying or selling a house, property, boat or car in another country, you can appoint a lawyer, notary or trusted person, to represent you. This means they can act according to your wishes, without you having to visit the country to sign needed documents or attend meetings.

How to legalize a power of attorney – step by step:

One of the essential points of a power of attorney is the signing of the document. It must be signed by the person issuing power to someone else, and the signing of the document must be ‘witnessed’ by a legal person like a notary or lawyer.

1- First, the Italian tax code must be arranged: The Codice Fiscale is the Italian tax code which you will require in getting into any legal relationship whatsoever, including your housing contract with the EUI. When purchasing a home, the notary or a lawyer or your agent/advisor will arrange the application to receive this code. The costs for this vary and are between €100 and -200 per person VAT included.

2- The notary or lawyer in Italy will draft a power of attorney on behalf of the buyer in the name of the attorney. The costs for compiling the power of attorney document differ per contract, but on average € 300.00 per person VAT included.

3- The trustee must be a person residing in Italy who is fluent in the Italian Language. This person may be nominated by the buyer. If not, a trustworthy person will be appointed by the notary or broker to act on behalf of the buyer. Of course, the process will take place in consultation and according to the wishes of the client. Keep in mind that sometimes the buyer also has to pay for the trustee. The costs are different, between € 150 and € 250 VAT included. for each power of attorney.

4- The power of attorney will be sent to the client by email or registered post.

5- Legalization of power of attorney: Visit the notary or solicitor and get them to witness you signing the document. You sign the document and then they sign adding the statement ‘witnessed by’ or ‘signed in my presence’. They must date the document, sign in their own name and, if applicable, add their notary stamp.

6- If your country also requires a translation into your own language, you will need to hire a sworn translator to translate the document. For English, we can prepare and email the document in Italian and English. The cost of the interpreter here is approximately €250 per power of attorney VAT included.

7- Then, with the power of attorney document, after authorization at the notary, the client must take this to a court to have the document provided with an apostille at the court. This is a stamp or sticker on the document. Your document can now be used overseas. Otherwise, the notary in Italy will arrange for the translation of the documents into Italian by a certified interpreter. The cost of the translation varies depending on the number of words and the language.
On average, the cost for European languages are approximately €250 per power of attorney VAT included..

8- Then make a clear colour-scan of all the documents and send them to us by email/ WhatsApp. Once we have checked that everything has been done correctly, you can proceed to the next step,

9- Send the original documents as soon as possible by registered mail to the notary or lawyer in Italy. We will always provide you with the address. The transfer contract cannot be signed without the original documents.

10- After this, the proposal agreement/ preliminary contract and the transfer contract (the deed of ownership) will be signed at the civil-law notary by the authorized representative (s).

11- The last step is, the notary will register the transfer contract/ the deed of ownership with the real estate registry office in Italy and after about 2-3 weeks the buyer or their representative can collect a title deed at the notary office.
